JSC 'Nurbank' (hereafter referred to as the Bank) declares the unlawful and unfair actions of LLP 'Capital Petrol', as a result of which innocent residents of the Residential Complex '7 Continent' may be left without housing.
In 2008, JSC 'Nurbank' provided a loan to LLP 'Capital Petrol' to acquire claims to equity participation in the housing construction of the Residential Complex '7 Continent'. At the time of receiving the loan, the Residential Complex was unfinished, and therefore the Bank accepted the claim to transfer apartments in the Residential Complex as collateral after the completion of construction.
After the completion of construction, LLP 'Capital Petrol' violated its obligations under the contract and did not transfer the real estate as collateral to the Bank, illegally selling them instead.
Currently, the specialized interdistrict economic court of Astana recognized the actions of LLP 'Capital Petrol' regarding the sale of apartments in the Residential Complex '7 Continent' as unlawful and obliged LLP 'Capital Petrol' to provide the apartments as collateral to the Bank.
The actions of LLP 'Capital Petrol' are unfair and unlawful. In this regard, the Bank demands LLP 'Capital Petrol' fulfill its obligations and repay the debt under the contract. In accordance with the current legislation of the Republic of Kazakhstan, if the court recognizes the transaction as invalid, LLP 'Capital Petrol' must return all money received from the illegal sale of apartments to the residents of the Residential Complex '7 Continent'.
