Notice of Rights of JSC "Nurbank" and Responsibilities of Borrower - Individual in Case of Borrower's Failure to Fulfill Obligations under the Bank Loan Agreement

Please be aware that in case of a borrower's failure to meet obligations under the loan agreement and failure to satisfy the bank's demands arising from the notice to fulfill obligations under the loan agreement, the bank is entitled to take the following actions:

  • apply penalties (fines, penalties) stipulated in the loan agreement for the borrower's breach of obligations;
  • unilaterally and uncontestedly seize the borrower's funds in any currency to repay overdue debts under the loan agreement (including, but not limited to, principal debt, remuneration, penalties, bank expenses, and other payments stipulated by the loan agreement, including by direct debit of the account and/or other bank accounts opened with the Bank and/or by presenting the bank's demands or other documents stipulated by Kazakhstani legislation to the borrower's accounts in other banks and/or organizations carrying out specific banking operations and other credit organizations; and/or
  • file a lawsuit to collect the borrower's debt under the loan agreement and foreclose on collateral out of court or through court proceedings; and/or
  • transfer the borrower's debt under the loan agreement for pretrial collection and settlement to a collection agency; and/or
  • assign the bank's claims under the loan agreement to third parties without the borrower's consent, complying with Kazakhstani legislation; and/or
  • alter the loan agreement provisions in ways specified in the loan agreement; and/or
  • demand the borrower fulfill obligations to repay the credit debt fully or partially, including early performance of all obligations under the loan agreement and other agreements between the bank and borrower; and/or
  • unilaterally and out of court refuse to provide or suspend credit provision without notifying the borrower; and/or
  • demand the pledge of property entirely covering the obligations under the loan agreement; and/or
  • exercise other rights stipulated by Kazakhstani legislation and the loan agreement.

In addition to liabilities arising from the above measures implemented by the bank, the borrower also pays a penalty (fine) as defined in the loan agreement for violating obligations regarding the insurance of collateral, including its renewal or extension, obligations concerning credit usage, and other non-monetary obligations under the loan agreement, as well as compensates the bank for all losses exceeding the penalty associated with the borrower's breach of obligations under the loan agreement and the bank's debt recovery actions.

Please note, a borrower who is an individual may within thirty calendar days from the date of loan performance default visit the bank and/or submit in writing or otherwise as provided by the contract, a statement explaining the reasons for the delay, income, and other substantiated circumstances underlying their request to amend contract terms, according to Clause 1-1 of Article 36 of the Kazakhstan 'Banking Law.' Subsequently, within fifteen calendar days of receiving such a statement, the bank will review the proposed contract amendments by the individual borrower and communicate in writing or otherwise as provided by the contract about:

  1. agreement to the proposed contract amendments;
  2. its own proposals to amend the contract terms;
  3. a refusal to amend the contract with a justified explanation for the refusal.

If the bank decides against changing the contract terms or fails to reach a mutually acceptable contract amendment with the individual borrower, within 15 (fifteen) calendar days from receiving the bank's decision, the borrower may apply to the Kazakhstan Agency for Financial Market Regulation and Development while simultaneously notifying the bank. Should the borrower fail to meet the bank's demand for payment under the contract, including overdue payments, according to Clause 2 of Article 36 of the Banking Law, the bank may uncontestably seize funds, including by presenting a payment demand, available on the borrower's bank accounts (if such seizure is stipulated in the contract), considering the limitations set by the Banking Law.

In cases where the borrower does not meet the bank's demand for payment, including unpaid debts, or fails to exercise rights as per Clause 1-1 of Article 36 of the Banking Law, or if there is no agreement between the individual borrower and the bank regarding contract amendments, under Clause 2-1 of Article 36 of the Banking Law, the bank may apply measures stipulated by Kazakhstani legislation and/or the contract, including but not limited to transferring debts for pretrial collection and settlement to a collection agency (if this right is provided in the contract), assigning claims under the contract to an entity listed in Clause 4 of Article 36-1 of the Banking Law, filing a lawsuit to collect the contract debt, and foreclosing on collateral out of court, except as provided by the Kazakhstan Law "On Real Estate Mortgage," or through court proceedings.

The decision to approve unsecured loans is made by the Bank's automated system or an authorized collegial body. Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.
