Notice of Rights of JSC "Nurbank" and the Responsibility of the Borrower - Individual in Case of Non-fulfillment of Obligations Under the Bank Loan Agreement

In cases of non-fulfillment and/or improper fulfillment by the borrower of obligations under the Agreement, the Bank has the right to:

We remind you that in case of the borrower's breach of obligations under the bank loan agreement and failure to satisfy the Bank's requirements arising from the Bank's notification on the necessity to fulfill obligations under the bank loan agreement, the Bank may apply the following measures:

  • apply the penalties (fines, fees) stipulated by the bank loan agreement for the borrower's breach of obligations under the agreement;
  • unilaterally withdraw funds of the borrower in any currency to cover overdue debt under the bank loan agreement (including, but not limited to, amounts owed for principal, remuneration, penalties (fees, fines), the Bank's expenses and losses, and other payments stipulated by the bank loan agreement, including through direct debit from an account and/or other bank accounts opened with the Bank, and/or by presenting payment demands to the borrower's accounts opened with other banks and/or organizations conducting specific types of banking operations, and other credit institutions as prescribed by the laws of the Republic of Kazakhstan; and/or
  • file a lawsuit to recover the borrower's debt under the bank loan agreement, as well as enforce collateral either extrajudicially or judicially; and/or
  • transfer the borrower's debt under the bank loan agreement for pre-trial collection and settlement to a collection agency; and/or
  • assign the Bank's claim rights under the bank loan agreement to third parties without the borrower's consent, in accordance with the laws of the Republic of Kazakhstan; and/or
  • alter the conditions for the execution of the bank loan agreement in the manner specified in the agreement; and/or
  • demand the borrower fulfill obligations to repay debt in full or in part as determined by the Bank, including demanding early fulfillment of all obligations under the bank loan agreement and other transactions concluded between the Bank and the borrower; and/or
  • unilaterally refuse or suspend provision of a loan to the borrower without any notice from the Bank; and/or
  • require collateral covering the full amount of obligations under the bank loan agreement; and/or
  • exercise other rights provided by the laws of the Republic of Kazakhstan and the bank loan agreement.

In addition to responsibility arising from the above measures applied by the Bank, the borrower also pays penalties (fines, fees) as determined by the bank loan agreement for breach of obligations related to the insurance of collateral, including renewal or extension of the insurance contract, obligations on the targeted use of the loan, and breach of other non-monetary obligations in accordance with the terms of the bank loan agreement; furthermore, the Bank is reimbursed for all losses in full amount beyond penalties, associated with the borrower's breach of obligations under the bank loan agreement and the Bank's actions related to debt collection.

We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date of the liability default under the bank loan agreement (hereafter referred to as the Agreement) to visit the Bank and/or submit in writing or in a manner provided for by the Agreement, an application containing information on the reasons for the default under the Agreement, income, and other verified conditions (facts) justifying their request for amendments to the Agreement terms, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter the Banking Law). The Bank shall, within fifteen calendar days after receiving the application submitted by the individual borrower pursuant to paragraph 1-1 of Article 36 of the Banking Law, review the changes proposed by the individual borrower to the Agreement terms and inform the individual borrower in writing or by the method provided for by the Agreement about:

  1. agreement with the proposed changes to the Agreement terms;
  2. its own proposals for changes to the Agreement terms;
  3. refusal to change the Agreement terms with a reasoned explanation of such refusal.

In the event of receiving a Bank decision refusing to change the Agreement terms or failing to reach a mutually acceptable decision to change the Agreement terms, the individual borrower has the right within 15 (fifteen) calendar days from the date of receiving the Bank's decision to contact the Agency of the Republic of Kazakhstan for financial market regulation and development with simultaneous notification of the Bank. If the borrower fails to satisfy the Bank's demand for payment under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Banking Law, the Bank has the right to unilaterally seize funds, including by presenting payment demands, available in the borrower's bank accounts (if such seizure is stipulated in the Agreement), within the limitations provided by the Banking Law.

In cases where the borrower fails to satisfy the Bank's demands for payment under the Agreement, including overdue debt, and does not exercise the rights of the individual borrower provided for in paragraph 1-1 of Article 36 of the Banking Law, or there is no agreement between the individual borrower and the Bank on amending the Agreement terms, in accordance with paragraph 2-1 of Article 36 of the Banking Law, the Bank may apply measures provided by the laws of the Republic of Kazakhstan and/or the Agreement in relation to the borrower, including, but not limited to, transferring debt for pre-trial collection and settlement to a collection agency (if such Bank's right is provided in the Agreement), assigning the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Banking Law, filing a lawsuit to recover debt under the Agreement, and also enforce collateral extrajudicially, except for cases provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate," or judicially.

Who makes the approval decision?

The decision to approve unsecured loans is made by the Bank's automated system or an authorized collegial body. Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

What are the ways to pay the monthly credit payment?

The payment can be made through the Nur24.kz mobile app, Nurbank terminals, as well as through the cash desks in the Bank's branches.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

What documents are needed to obtain a loan?

What is the date of the first loan payment?

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

You need to contact the credit manager to submit a request to change loan terms.

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

We recommend you to repay the overdue debt.

What to do if your phone number/address of registration/residence has changed?

You need to update your personal information. Please visit the nearest Bank branch or notify the Bank in writing.

No. At present, all loans are processed through the branches of Nurbank.

Can I purchase real estate on the secondary market through Nurbank?

Yes, Nurbank offers its own mortgage lending program for purchasing secondary housing.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?

Can I purchase a car on credit through Nurbank?
