Appendix No. 4. Legal Entity Questionnaire for Tender Participation

Dear Ladies and Gentlemen,

JSC “Nurbank” announces an open tender on December 18, 2014, for selecting potential suppliers for the following two lots.

Lot No.1. Payment terminals and their technical support

Lot No.2. Software for payment terminals and its service support
The subject of the tender is the best proposal for a contract to supply payment terminals.

Type of tender: open

Start of trading: 18.12.2014, 14:30, at the address: 51-53 Abai Khan Ave., 5th floor, large conference hall

End of trading: 18.12.2014, 18:00

Submission of proposals until: 17.12.2014, 12:00, at the address: 51-53 Abai Khan Ave.

Market experience: at least 5 years

Availability of service centers: required

Availability of certified specialists: required

Delivery conditions: DDP

Prepayment terms: no more than 50%

Delivery/installation time: no more than 45 calendar days

Warranty period: at least 12 months

Eligibility for the tender is given to potential suppliers who meet the following requirements:

  1. possess professional competence and experience, have necessary financial, material, and labor resources to fulfill obligations as per the delivery contract
  2. be solvent, not under liquidation, no arrest on property, financial activity not suspended
  3. proposed payment terminals must be tested at the manufacturer's plant and comply with technical requirements
  4. software cost must include license fees
  5. software, including all necessary components, must be licensed
  6. provide documents proving the right to use the software following the supplier's country legislation
  7. deliver the purchased payment terminals under the best payment conditions
  8. deliver the purchased payment terminals to installation sites under DDP terms without extra payment
  9. conduct free training on payment terminals for six Bank employees
  10. present a partnership certificate from the manufacturer and an authorized letter from the equipment manufacturer for supplying and servicing payment terminals as per the supplier's country legislation
  11. possess authorization letters and security certificates from equipment manufacturers
  12. provide certificates of training/participation of the applicant's employees in payment terminal workshops
  13. ensure warranty maintenance of payment terminals (for free) for at least 1 year from delivery
  14. ensure free correction of software errors (for free) for at least 1 year from installation
  15. offer the best post-warranty service conditions
  16. service center or partner for warranty service of delivered payment terminals must be available in Almaty and regions to which terminals are delivered (include name, address, and contact information)
  17. provide recommendations for successful large scale projects in Kazakhstan
  18. discount system and pricing policy for five-year service maintenance
  19. discount system and pricing policy for five-year technical maintenance
  20. the potential supplier bears all costs associated with preparation and submission of their tender, and the Bank and the tender committee have no responsibility or obligation regarding these expenses, irrespective of how the tender is conducted and the outcome

Technical specification and product descriptions are provided in Appendices №1 and №2.

To participate in the tender, the following documents must be submitted:

Legal documentation:

  1. application for tender participation in the prescribed form, as per the Tender Participation Application in Russian/Kazakh (Appendix №3);
  2. notarized copies of constituent documents, registration/re-registration certificate of a legal entity or registration certificate of an individual entrepreneur (Charter, VAT registration certificate);
  3. copies of licenses (original for verification) for conducting state-licensed activities (if applicable);
  4. notarized copy of identity document for authorized representative;
  5. supplier authorization for the authorized representative to participate in the Tender.

Financial documentation:

  1. price proposals;
  2. completed questionnaires for legal entity, individual entrepreneur, or individual as per Nurbank’s Internal Control Rules for Prevening Legalization (Money Laundering) of Illicit Income and Terrorist Financing (Appendices №4 and №5);
  3. original certificate from the servicing bank confirming the applicant's bank details, no overdue debts to the bank, no restrictions on fund management;
  4. copies of financial statements for legal entities for 2013, sealed by legal entities, tax declarations for individual entrepreneurs, sealed if available;
  5. original certificate from the Tax Committee of the applicant's registration location, confirming no tax debts;
  6. copies of recommendations and reviews from legal entities/individual entrepreneurs previously collaborating with the applicant, containing assessments and qualifications of cooperative experience, including timeliness, completeness of obligations, and more (if available);
  7. information about available material and technical base (if available);
  8. copies of Corporate Income Tax Declarations for the two years preceding the Tender. If losses exist in tax records for the two preceding years, the participant must justify the price of the offered goods/services (for international business transactions).

JSC “Nurbank” notes that the Bank's Tender Committee may not disclose information regarding the review, evaluation, and comparison of tender applications to potential service providers or any other non-official parties.

JSC “Nurbank” reserves the right to cancel or defer the tender, with written notice to potential suppliers who have submitted applications about the tender cancellation or rescheduling, indicating the new date.

A potential supplier has the right to modify or withdraw their application before the final tender application submission deadline.

Requirements for submitted proposals:

Proposals must include:

  1. Description of the proposed system;
  2. Detailed server landscape scheme;
  3. Instruction for switching to backup servers;
  4. Description of the licensing scheme;
  5. Priced offer for the system implementation and support;
  6. For non-residents - tax nuances and determination of the tax payment source must be reflected in the price offer;
  7. Proposal for transferring the source code of the software product to the customer;
  8. Description of the bank's infrastructure requirements and a method for calculating the needed computational capacities based on quantitative metrics (number of transactions, users, etc.);
  9. Project implementation schedule and readiness to start information;
  10. Service and technical maintenance pricing policy for 5 (five) years;
  11. References to similar completed projects and a brief description of the project experience;
  12. Contact information for the supplier and their authorized representative.

Award criteria:

Winner is determined based on price, delivery time, technical specifications, and compliance with supplier requirements.

Summarization is conducted according to approved Nurbank Regulations.

Potential suppliers' representatives may attend bid opening upon presentation of authorization confirmation.

Proposals referencing open tender participation will be accepted from authorized persons only via email in any common MS format (scanned documents - in rar files, the commercial offer in Excel format).
