Notice of Rights of JSC "Nurbank" and Liability of the Borrower — Individual in Case of Non-fulfillment of the Borrower's Obligations under the Bank Loan Agreement

We remind you that in the event of the borrower's breach of obligations under the bank loan agreement and the borrower's failure to satisfy the demands arising from the Bank's notice of the need to fulfill obligations under the bank loan agreement, the Bank is entitled to take the following measures:

  • apply penalties (fines, late fees) stipulated by the bank loan agreement for the borrower's breach of obligations under the bank loan agreement;
  • unilaterally withdraw the borrower's funds in any currency to cover overdue debt under the bank loan agreement (including, but not limited to, amounts outstanding in principal, interest, penalties (late fees, fines), Bank's expenses and losses, and other payments stipulated by the bank loan agreement, including by direct debiting of accounts and/or other bank accounts opened with the Bank, and/or presenting demands for payment to the borrower's bank accounts opened with other banks and/or institutions carrying out certain types of banking operations, and other credit organizations; and/or
  • file a claim in court to recover the borrower's debt under the bank loan agreement, as well as proceed against pledged property out of court or in court; and/or
  • assign the borrower's debt under the bank loan agreement to a collection agency for pre-trial collection and settlement; and/or
  • assign the Bank's claims under the bank loan agreement in favor of third parties without the borrower's consent, considering the requirements of the legislation of the Republic of Kazakhstan; and/or
  • change the terms of performance of the bank loan agreement by the methods specified in the bank loan agreement; and/or
  • demand the borrower to repay the credit debt in full or in parts determined by the Bank, including requiring early repayment of all obligations under the bank loan agreement and other transactions concluded between the Bank and the borrower; and/or
  • unilaterally refuse to grant the borrower a loan or suspend the loan without providing any notices from the Bank; and/or
  • demand providing collateral that fully covers the obligations under the bank loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to the liability arising from the aforementioned measures taken by the Bank, the borrower is also subject to penalties (fine, late fee) determined by the bank loan agreement for violation of obligations to insure the collateral, including renewing or extending the insurance contract, obligations for the intended use of the loan, and violation of other non-monetary obligations in accordance with the terms of the bank loan agreement, as well as compensating the Bank for all damages in full beyond the penalty, related to the borrower's breach of obligations under the bank loan agreement and the measures the Bank takes to collect the debt.

We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date of the overdue obligation under the bank loan agreement (hereafter referred to as the Agreement) to visit the Bank and/or submit, in writing or by the method provided for in the Agreement, an application containing information on the reasons for the overdue obligation under the Agreement, income, and other verified circumstances (facts), which support their application to amend the Agreement under paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereafter referred to as the Law on Banks). Within fifteen calendar days after receiving the individual's application specified in paragraph 1-1 of Article 36 of the Law on Banks, the Bank will review the changes proposed by the individual to the Agreement conditions and, in writing or by the method provided in the Agreement, will inform the individual about:

  1. agreement with the proposed changes to the Agreement conditions;
  2. its proposals to amend the Agreement conditions;
  3. refusal to change the Agreement conditions with a motivated explanation of the reasons for such refusal.

In the case of receiving the Bank's decision to refuse to change the Agreement conditions or failing to reach a mutually acceptable decision to amend the Agreement conditions, the individual has the right, within 15 (fifteen) calendar days from the date of receiving the Bank's decision, to contact the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, while simultaneously notifying the Bank. If the borrower fails to satisfy the Bank's demand to make payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Law on Banks, the Bank may take enforcement action on funds, including by presenting a demand for payment from the borrower's bank accounts (if such enforcement is provided for in the Agreement), taking into account the restrictions provided by the Law on Banks.

In cases where the borrower does not satisfy the Bank's demand to make payments under the Agreement, including overdue debt, and does not exercise the rights provided to the individual by paragraph 1-1 of Article 36 of the Law on Banks, or if there is no agreement between the individual and the Bank on amending the Agreement conditions, the Bank has the right, in accordance with paragraph 2-1 of Article 36 of the Law on Banks, to apply measures against the borrower as provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including, but not limited to, transferring the debt for pre-trial collection and settlement to a collection agency (if such a right is provided to the Bank in the Agreement), assigning the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Law on Banks, filing a claim in court to collect the debt amount under the Agreement, and also proceed against pledged property out of court, except as provided by the Law of the Republic of Kazakhstan "On Mortgage of Immovable Property", or in court.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

What documents are needed to obtain a loan?

What is the date of the first loan payment?

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

We recommend you to repay the overdue debt.

What to do if your phone number/address of registration/residence has changed?

You need to update your personal information. Please visit the nearest Bank branch or notify the Bank in writing.

No. At present, all loans are processed through the branches of Nurbank.

Can I purchase real estate on the secondary market through Nurbank?

Yes, Nurbank offers its own mortgage lending program for purchasing secondary housing.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?

From 21 years of age until reaching retirement age.

Can I purchase a car on credit through Nurbank?
