Notice of the Rights of JSC "Nurbank" and the Responsibility of the Borrower – Individual in the Event of Non-fulfillment of Obligations under the Bank Loan Agreement

Please note that, in the event of a borrower's default on the banking loan agreement and failure to meet the requirements arising from the Bank's notice to fulfill obligations under the banking loan agreement, the Bank may take the following measures:

  • impose penalties (fines, charges) specified in the banking loan agreement for the borrower's breach of obligations thereunder;
  • unilaterally seize the borrower's funds in any currency to settle overdue debt under the banking loan agreement (including but not limited to the main debt, remuneration, penalties, expenses and losses of the Bank, and other payments stipulated by the banking loan agreement), by directly debiting accounts and/or other bank accounts opened with the Bank, and/or by submitting payment demands to bank accounts in other banks and/or organizations conducting separate banking operations, and other credit organizations as provided by the legislation of the Republic of Kazakhstan; and/or
  • file a lawsuit to collect the borrower's debt under the banking loan agreement, as well as take possession of pledged property out of court or via legal proceedings; and/or
  • transfer the borrower's debt under the banking loan agreement for pre-judicial collection and settlement to a collection agency; and/or
  • assign the Bank's claims under the banking loan agreement to third parties without the borrower's consent, complying with the legislation of the Republic of Kazakhstan; and/or
  • modify the terms of the banking loan agreement as provided in the agreement; and/or
  • demand the borrower to fulfill obligations to repay the credit, in full or as determined by the Bank, including requesting early fulfillment of all obligations under the banking loan agreement and other transactions between the Bank and the borrower; and/or
  • unilaterally and out of court refuse to provide credit to the borrower or suspend credit provision without notifying the borrower of such action; and/or
  • require the borrower to pledge assets fully covering the obligations under the banking loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the banking loan agreement.

In addition to the liability arising from the above measures taken by the Bank, the borrower also pays a penalty (fine, charge) in the amount set by the banking loan agreement for violation of obligations regarding the insurance of the pledged property, including renewal or extension of the insurance contract, obligations for the targeted use of the credit, and breach of other non-monetary obligations in accordance with the banking loan agreement. The Bank is also compensated for all losses exceeding the penalties arising from the borrower's breach of obligations under the banking loan agreement and the actions taken by the Bank to recover the debt.

We notify you that if the borrower is an individual, they have the right, within thirty calendar days from the date of default on a banking loan agreement obligation (hereinafter - the Agreement), to visit the Bank and/or submit a written statement or through a method specified in the Agreement, containing information on the reasons for the default, income, and other confirmed circumstances (facts) that justify their request for changes to the Agreement conditions, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter - the Law on Banks). Within fifteen calendar days after receiving such a statement from the borrower - an individual, the Bank will review the proposed changes to the Agreement conditions and notify the borrower - an individual in writing or through a method specified in the Agreement about:

  1. payment demands Bank's willingness to accept the proposed changes to the Agreement conditions;
  2. the Bank's proposals for changing the Agreement conditions;
  3. the Bank's refusal to change the Agreement conditions, stating the reasons for such refusal.

In the event of the Bank's decision to reject changing the Agreement conditions or failure to reach a mutually acceptable solution, the borrower - an individual, within 15 (fifteen) calendar days from the date of receiving the Bank's decision, has the right to appeal to the Agency of the Republic of Kazakhstan for the Regulation and Development of the Financial Market, concurrently notifying the Bank. If the borrower fails to meet the Bank's requirement to make payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Law on Banks, the Bank may enforce the pending claim without dispute on the borrower's funds, including by submitting a payment demand, identified on the borrower's bank accounts (if such recovery is provided for in the Agreement), considering the restrictions established by the Law on Banks.

In cases where the borrower fails to meet the Bank's requirement to make payments under the Agreement, including overdue debt, and does not exercise the rights provided by paragraph 1-1 of Article 36 of the Law on Banks, or in the absence of agreement between the borrower - an individual and the Bank on changing the Agreement conditions, in accordance with paragraph 2-1 of Article 36 of the Law on Banks, the Bank may apply measures to the borrower provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to transferring the debt for pre-judicial collection and settlement to a collection agency (if such right of the Bank is available in the Agreement), assigning the right (claim) under the Agreement to the person specified in paragraph 4 of Article 36-1 of the Law on Banks, filing a lawsuit to recover the debt amount under the Agreement, as well as foreclosing the pledged property out of court, except for cases provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate", or through judicial proceedings.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

How to execute a full early repayment?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?
