Notification of the Rights of JSC 'Nurbank' and the Responsibility of the Borrower-Individual in Case of Non-fulfillment of Obligations Under the Bank Loan Agreement

We remind you that in case of the Borrower's violation of the obligations under the bank loan agreement and the Borrower's failure to satisfy the requirements arising from the Bank's notification of the need to fulfill the obligations under the bank loan agreement, the Bank is entitled to take the following measures:

  • apply penalties (fines, penalties) provided for by the bank loan agreement for the Borrower's violation of obligations under the bank loan agreement;
  • indisputably seize the Borrower's funds in any currency to repay overdue debt under the bank loan agreement (including, but not limited to, amounts of principal debt, remuneration, penalty sums (fines, penalties), expenses and losses of the Bank and other payments provided for by the bank loan agreement, including by direct debiting from the account and/or other bank accounts opened at the Bank, and/or by presenting the Bank's payment demands or other documents as provided by the legislation of the Republic of Kazakhstan to the Borrower's bank accounts opened at other banks and/or organizations carrying out certain types of banking operations, and other credit organizations); and/or
  • file a lawsuit to recover the Borrower's debt under the bank loan agreement and seize pledged property in an extrajudicial procedure or in a judicial procedure; and/or
  • transfer the Borrower's debt under the bank loan agreement for pre-trial collection and settlement to a collection agency; and/or
  • assign the Bank's claims under the bank loan agreement to third parties without the Borrower's consent, subject to the requirements of the legislation of the Republic of Kazakhstan; and/or
  • change the terms of fulfillment of the bank loan agreement in the ways specified in the bank loan agreement; and/or
  • demand that the Borrower fulfill obligations to repay the debt, both in full and in part determined by the Bank, including demanding early fulfillment of all obligations under the bank loan agreement and other transactions concluded between the Bank and the Borrower; and/or
  • unilaterally and extrajudicially refuse to extend or suspend the loan provision without notifying the Borrower of this: and/or
  • demand the provision of collateral in an amount fully covering the obligations under the bank loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to the liability arising from the above measures applied by the Bank, the Borrower is also liable for a penalty (fine, penalty) in the amount determined by the bank loan agreement for violating the insurance obligations of the pledged item, including the renewal or extension of the insurance contract, obligations for the purposeful use of the loan and violation of other non-monetary obligations in accordance with the terms of the bank loan agreement, as well as reimbursing the Bank for all losses in full amount beyond the penalty related to the Borrower's violation of obligations under the bank loan agreement and the Bank's measures related to the debt collection.

We inform you that if the Borrower is an individual, they have the right within thirty calendar days from the date the delay in fulfilling the obligation under the bank loan agreement (hereinafter - the Agreement) occurs, to visit the Bank and/or submit in writing or in a manner provided by the Agreement, an application containing information about the reasons for the delay in fulfilling the obligation under the Agreement, income, and other confirmed circumstances (facts) that justify their request for changes to the conditions of the Agreement, in accordance with paragraph 1-1 Article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking Activities in the Republic of Kazakhstan' (hereinafter - the Law on Banks). At the same time, within fifteen calendar days after the day the application of the Borrower-individual is received, as provided for in paragraph 1-1 Article 36 of the Law on Banks, the Bank considers the changes to the conditions of the Agreement proposed by the Borrower-individual and informs the Borrower-individual in writing or in a manner provided by the Agreement about:

  1. agreement with the proposed changes to the conditions of the Agreement;
  2. its proposals for changing the conditions of the Agreement;
  3. refusal to change the conditions of the Agreement with a motivated explanation of the reasons for such refusal.

In case of receiving the Bank's decision to refuse to change the conditions of the Agreement or failure to reach a mutually acceptable decision, the Borrower-individual has the right within 15 (fifteen) calendar days from the date of receiving the Bank's decision to contact the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market while simultaneously notifying the Bank. If the Borrower fails to satisfy the Bank's demand for the need to make payments under the Agreement, including overdue debts, in accordance with paragraph 2 Article 36 of the Law on Banks, the Bank is entitled to take recourse in an indisputable manner on the funds, including by presenting a payment demand available on the Borrower's bank accounts (if such a claim is stipulated in the Agreement), subject to the restrictions provided for by the Law on Banks.

In cases of failure to satisfy the Bank's demand for the need to make payments under the Agreement, including overdue debts, as well as the Borrower-individual not exercising the rights provided for in paragraph 1-1 Article 36 of the Law on Banks or lack of agreement between the Borrower-individual and the Bank regarding changes to the conditions of the Agreement, in accordance with paragraph 2-1 Article 36 of the Law on Banks, the Bank is entitled to apply measures towards the Borrower as provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to, transfer the debt for pre-trial collection and settlement to a collection agency (if the Bank has such right in the Agreement), assign the rights (claims) under the Agreement to the person specified in paragraph 4 Article 36-1 of the Law on Banks, file a lawsuit to recover the debt amount under the Agreement, and seize pledged property in an extrajudicial procedure, except in cases provided by the Law of the Republic of Kazakhstan 'On Mortgage of Immovable Property', or in a judicial procedure.

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.
