Notification of the Rights of JSC 'Nurbank' and the Responsibility of the Borrower-Individual in Case of Non-fulfillment of Obligations Under the Bank Loan Agreement

We remind you that in the event the borrower fails to fulfill obligations under the bank loan agreement and does not satisfy the bank's requirements arising from the bank's notice of the need to fulfill obligations under the bank loan agreement, the bank has the right to take the following measures:

  • apply penalties (fines, fees) stipulated by the bank loan agreement for the borrower's failure to meet obligations under the bank loan agreement;
  • unilaterally withdraw the borrower's funds in any currency to repay overdue debt under the bank loan agreement (including, but not limited to, amounts owed for principal, interest, penalty amounts (fees, fines), bank expenses and losses, and other payments stipulated by the bank loan agreement) including direct debit from the borrower's accounts with other banks or organizations conducting separate banking operations and collection through bank claims or other documents stipulated by the laws of the Republic of Kazakhstan; and/or
  • file a lawsuit to recover the borrower's debt under the bank loan agreement and/or take recourse on pledged assets either extra-judicially or judicially; and/or
  • transfer the borrower's debt under the bank loan agreement for pre-trial collection and settlement to a collection agency; and/or
  • assign the bank's claims under the bank loan agreement to third parties without the borrower's consent, considering requirements of the legislation of the Republic of Kazakhstan; and/or
  • modify the terms of executing the bank loan agreement in the manners outlined in the bank loan agreement; and/or
  • demand that the borrower repay the loan debt either in full or partially as determined by the bank, including the requirement for early fulfillment of all obligations under the bank loan agreement and other transactions concluded between the bank and the borrower; and/or
  • unilaterally refuse to provide the borrower with a loan or suspend the provision of the loan without notifying the borrower in this regard; and/or
  • require the borrower to pledge assets that fully cover the obligations under the bank loan agreement; and/or
  • exercise any other rights provided by the laws of the Republic of Kazakhstan and the bank loan agreement.

In addition to liability resulting from the measures applied by the bank, the borrower is also subject to a penalty (fine, fee) as determined by the bank loan agreement for breaching obligations regarding the insurance of collateral, including the renewal or extension of the insurance contract, the obligations upon the targeted use of credit, and other non-monetary obligations as per the bank loan agreement's conditions. Additionally, the bank is reimbursed for all losses exceeding the penalty in full due to the borrower's breach of obligations under the bank loan agreement and activities conducted by the bank for debt collection.

We inform you that if the borrower is an individual, he/she has the right to visit the bank and/or submit a written application containing the reasons for the delay in obligation fulfillment under the bank loan agreement (hereafter referred to as the Agreement), incomes, and other verified circumstances (facts) that justify his/her application for amendment in the Agreement's conditions in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activity in the Republic of Kazakhstan" (hereafter referred to as the Banking Law) within thirty calendar days from the date of default under the Agreement. Following this, within fifteen calendar days from the day of receiving the borrower's - individual - application as per paragraph 1-1 of Article 36 of the Banking Law, the bank reviews the proposed amendments by the borrower - individual - and informs the borrower - individual - in writing or by means specified in the Agreement regarding its:

  1. agreement with the proposed changes to the Agreement's conditions;
  2. own proposals for changing the Agreement's conditions;
  3. refusal to change the Agreement's conditions with a motivated explanation for such refusal.

If the bank's decision to refuse changes to the Agreement's conditions is received or if a mutually acceptable solution for changing conditions is not achieved, the borrower - individual - within 15 (fifteen) calendar days from the date of receiving the bank's decision has the right to apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market while simultaneously notifying the bank. If the borrower fails to meet the bank's payment demands under the Agreement, including overdue debt, as per paragraph 2 of Article 36 of the Banking Law, the bank has the right to initiate a unilateral recovery action on the money, including presenting payment demands on funds present in the borrower's bank accounts (if such recovery is stipulated in the Agreement), considering restrictions outlined by the Banking Law.

In cases where the borrower fails to meet the bank's payment demands under the Agreement, including overdue debt, doesn't exercise his/her rights under paragraph 1-1 of Article 36 of the Banking Law, or if there is no agreement between the borrower - individual - and the bank on changing the Agreement's terms, as per paragraph 2-1 of Article 36 of the Banking Law, the bank has the right to apply measures stipulated by the laws of the Republic of Kazakhstan and/or the Agreement against the borrower, including, but not limited to, transferring the debt for pre-trial collection and settlement to a collection agency (if the bank's rights are stipulated in the Agreement), assign claims under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Banking Law, file a lawsuit in court to recover the debt amount under the Agreement, and take recourse on pledged property through an extra-judicial procedure, except in cases provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate", or through a judicial procedure.

Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

The payment can be made through the Nur24.kz mobile app, Nurbank terminals, as well as through the cash desks in the Bank's branches.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

No. At present, all loans are processed through the branches of Nurbank.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?
