Notice of Rights of JSC "Nurbank" and Borrower's Liability in Case of Default on Bank Loan Agreement Obligations

We remind you that in case of a borrower's breach of obligations under the banking loan agreement and failure to satisfy the bank's requirements arising from the bank's notice to fulfill obligations under the banking loan agreement, the bank is entitled to apply the following measures:

  • to apply penalties (fines, fees) stipulated by the banking loan agreement for the borrower's breach of obligations under the banking loan agreement;
  • to unilaterally withdraw borrower's funds in any currency to settle overdue debts under the banking loan agreement (including, but not limited to, debt amounts on principal, remuneration, penalty (fees, fines) amounts, bank's expenses and losses, and other payments as provided by the banking loan agreement, including direct debiting of accounts and/or other bank accounts opened at the bank, and/or by presenting bank's payment demands or other documents, as provided by the legislation of the Republic of Kazakhstan, to borrower's bank accounts opened in other banks and/or organizations conducting certain types of banking operations, and other credit institutions; and/or
  • to file a lawsuit to recover the borrower's debt under the banking loan agreement, as well as to foreclose on pledged property in an extrajudicial manner or through the court; and/or
  • to transfer the borrower's debt under the banking loan agreement for pretrial recovery and settlement to a collection agency; and/or
  • to assign the bank's rights of claim under the banking loan agreement in favor of third parties without the borrower's consent, considering the requirements of the legislation of the Republic of Kazakhstan; and/or
  • to alter the terms of the banking loan agreement in ways specified in the banking loan agreement; and/or
  • to demand that the borrower fulfills the obligations to repay the debt, either in full or in a part determined by the bank, including demanding early fulfillment of all obligations under the banking loan agreement and other transactions concluded between the bank and the borrower; and/or
  • to unilaterally refuse to provide credit to the borrower or to suspend credit provision without sending any notices to the borrower from the bank; and/or
  • to demand the provision of collateral covering the amount of obligations under the banking loan agreement in full; and/or
  • to exercise other rights provided by the legislation of the Republic of Kazakhstan and the banking loan agreement.

In addition to the liability arising from the aforementioned measures applied by the bank, the borrower also pays a penalty (fine, fee) in the amount specified by the banking loan agreement for violating obligations related to insuring the collateral, including renewing or extending the insurance contract, obligations on the targeted use of the credit, and other non-monetary obligations according to the terms of the banking loan agreement, and also reimburses the bank for all fully incurred losses beyond the penalty due to the borrower's violation of obligations under the banking loan agreement and actions by the bank related to debt collection.

We inform you that if the borrower is an individual, they are entitled to visit the bank within thirty calendar days from the date of default under the banking loan agreement (hereinafter - Agreement) and (or) to submit in writing or by means provided by the Agreement an application containing information about the reasons for the default under the Agreement, incomes, and other verified circumstances (facts) justifying their application to amend the terms of the Agreement, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking Activities in the Republic of Kazakhstan' (hereinafter - Banking Law). In this regard, within fifteen calendar days after the day of receipt of the application, the bank considers the proposed amendments by the individual borrower to the Agreement's terms and notifies the individual borrower in writing or by the means provided by the Agreement about:

  1. Agreement with the proposed amendments to the Agreement's terms;
  2. Its proposals for amending the Agreement's terms;
  3. Refusal to amend the Agreement's terms with a reasoned justification for such refusal.

In case of receiving the bank's decision to refuse amendments to the Agreement's terms or failure to reach a mutually acceptable decision on amending the Agreement, the individual borrower may, within 15 (fifteen) calendar days from the date of receiving the bank's decision, apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market with simultaneous notification to the bank. In case the borrower's failure to satisfy the bank's demand for payment under the Agreement, including overdue debt, pursuant to paragraph 2 of Article 36 of the Banking Law, the bank is entitled to enforce uncontentiously the borrower's funds, including by presenting a payment demand, available on the borrower's bank accounts (if such enforcement is stipulated in the Agreement), taking into account the limitations provided by the Banking Law.

In cases of the borrower's failure to satisfy the bank's demand for payment under the Agreement, including overdue debt, as well as failure by the individual borrower to exercise the rights provided by paragraph 1-1 of Article 36 of the Banking Law, or lack of agreement between the individual borrower and the bank on amendments to the Agreement, according to paragraph 2-1 of Article 36 of the Banking Law, the bank is entitled to apply measures against the borrower provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including, but not limited to, transferring the debt for pre-trial recovery and settlement to a collection agency (in case the bank has such a right under the Agreement), assigning the right (claim) under the Agreement to the person specified in paragraph 4 of Article 36-1 of the Banking Law, filing a lawsuit to recover the debt amount under the Agreement, as well as foreclosing on pledged property in an extrajudicial manner, except for the cases provided by the Law of the Republic of Kazakhstan 'On Mortgage of Real Estate', or through the judicial process.

The decision to approve unsecured loans is made by the Bank's automated system or an authorized collegial body. Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

What documents are needed to obtain a loan?

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

We recommend you to repay the overdue debt.

What to do if your phone number/address of registration/residence has changed?

You need to update your personal information. Please visit the nearest Bank branch or notify the Bank in writing.

No. At present, all loans are processed through the branches of Nurbank.

Can I purchase real estate on the secondary market through Nurbank?

Yes, Nurbank offers its own mortgage lending program for purchasing secondary housing.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?

Can I purchase a car on credit through Nurbank?
