Notification of the Rights of JSC 'Nurbank' and the Responsibilities of the Borrower - Individual in Case of Non-fulfillment of Obligations under the Bank Loan Agreement

Please be reminded that in the event of a borrower's violation of obligations under a bank loan agreement and the borrower's failure to satisfy the Bank's demands resulting from the notice of the necessity to fulfill the obligations under the bank loan agreement, the Bank has the right to take the following measures:

  • apply penalties (fines, interest) stipulated by the bank loan agreement for the borrower's breach of his obligations under the bank loan agreement;
  • indisputably seize the borrower's funds in any currency to settle overdue debt under the bank loan agreement (including but not limited to amounts of principal debt, remuneration, penalty amounts (interest, fines), Bank's expenses and losses, and other payments stipulated by the bank loan agreement) directly by debiting the borrower's account and/or other bank accounts opened with the Bank, and/or by presenting payment demands or other documents provided for by the legislation of the Republic of Kazakhstan to the borrower's bank accounts opened with other banks and/or organizations undertaking certain types of banking operations;
  • file a lawsuit to recover the borrower's debt under the bank loan agreement and take possession of the collateral property either out of court or in a judicial manner; and/or
  • transfer the borrower's debt under the bank loan agreement to a collection agency for pre-trial recovery and settlement; and/or
  • assign the Bank's claims under the bank loan agreement in favor of third parties without the borrower's consent, considering the requirements of the legislation of the Republic of Kazakhstan; and/or
  • change the terms of execution of the bank loan agreement in ways specified in the bank loan agreement; and/or
  • require the borrower to fulfill obligations to repay the debt in whole or in part as determined by the Bank, including demanding early performance of all obligations under the bank loan agreement, as well as other transactions concluded between the Bank and the borrower; and/or
  • unilaterally and out of court refuse to provide the borrower with credit or suspend credit provision without sending any Bank notifications to the borrower about this; and/or
  • require collateral provision that fully covers the obligations under the bank loan agreement; and/or
  • exercise other rights provided for by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to liabilities arising from the aforementioned measures taken by the Bank, the borrower also pays a penalty (fine, interest) in the amount specified in the bank loan agreement for the breach of obligations related to insuring the collateral object, including the renewal or extension of the insurance contract, obligations regarding the targeted use of credit, and breaches of other non-monetary obligations in accordance with the terms of the bank loan agreement, as well as compensates the Bank for all losses in full that exceed the penalty due to the borrower's violation of obligations under the bank loan agreement and the Bank's actions in debt recovery.

We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date of delay in fulfilling the obligation under the bank loan agreement (hereinafter - Agreement) to visit the Bank and/or submit in writing or in a manner provided by the Agreement, an application containing information about the reasons for the delay in fulfilling the obligation under the Agreement, income, and other confirmed circumstances (facts) that justify their statement for amending the Agreement, in accordance with clause 1-1 of article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking Activity in the Republic of Kazakhstan' (hereinafter - the Banking Law). In this case, within fifteen calendar days after receiving the application from the individual borrower provided for in clause 1-1 of article 36 of the Banking Law, the Bank reviews the proposed changes to the Agreement and in writing or as specified in the Agreement, informs the individual borrower about:

  1. agreement with the proposed changes to the Agreement;
  2. its proposals for amending the Agreement;
  3. refusal to amend the Agreement with a reasoned justification for the reasons for such refusal.

In case of receiving a Bank's decision to refuse changes to the Agreement or if a mutually acceptable solution to amend the Agreement is not reached, the individual borrower has the right within 15 (fifteen) calendar days from the date of receiving the Bank's decision to contact the Agency of the Republic of Kazakhstan for the regulation and development of the financial market, while simultaneously notifying the Bank. If the borrower fails to meet the Bank's demand for payment under the Agreement, including overdue debt, according to clause 2 of article 36 of the Banking Law, the Bank has the right to indisputably seize funds, including by issuing a payment demand, available on the borrower's bank accounts (if such seizure is provided for in the Agreement), taking into account the limitations stipulated by the Banking Law.

In cases where the borrower does not satisfy the Bank's demand for payment under the Agreement, including overdue debt, and the individual borrower does not exercise the rights provided under clause 1-1 of article 36 of the Banking Law, or if there is no agreement between the individual borrower and the Bank on amending the Agreement’s terms, according to clause 2-1 of article 36 of the Banking Law, the Bank may apply measures against the borrower provided for by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to, transfer the debt for pre-trial recovery and settlement to a collection agency (if such a right of the Bank exists under the Agreement), assign the right (claim) under the Agreement to a person specified in clause 4 of article 36-1 of the Banking Law, file a lawsuit in court to recover the debt under the Agreement, and also seize the pledged property out of court, except in cases provided for by the Law of the Republic of Kazakhstan 'On Mortgage of Real Estate', or in a judicial manner.

The minimum term is 12 months, the maximum term is 60 months.

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?

From 21 years of age until reaching retirement age.

Can I purchase a car on credit through Nurbank?
