In addition to liability arising from the aforementioned measures applied by the Bank, the borrower also pays a penalty (fine, fee) in the amount specified in the bank loan agreement for the breach of obligations to insure the collateral, including renewal or extension of the insurance contract, obligations for the targeted use of the loan, and breach of other non-monetary obligations in accordance with the terms of the bank loan agreement, as well as reimburses the Bank for all losses in full amount beyond the penalty, associated with the borrower's breach of obligations under the bank loan agreement and the Bank's actions related to debt collection.
We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date the overdue obligation under the bank loan agreement (hereinafter - the Agreement) occurred to visit the Bank and/or submit in written form or by the manner provided for by the Agreement an application containing information about the reasons for the overdue obligation under the Agreement, income, and other confirmed circumstances (facts) that justify their application for amendments to the conditions of the Agreement, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter - Bank Law). In case of the Bank's decision to refuse changes to the conditions of the Agreement or failure to reach a mutually acceptable decision on changing the conditions of the Agreement, the borrower - individual, within 15 (fifteen) calendar days from the date of receipt of the Bank's decision, has the right to apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market with simultaneous notification of the Bank. If the borrower does not comply with the Bank's demand to make payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Bank Law, the Bank has the right to unilaterally target the borrower's funds by presenting a payment demand available on the borrower's bank accounts (if such recovery is stipulated in the Agreement), considering the limitations specified in the Bank Law.
In cases where the borrower does not comply with the Bank's demand to make payments under the Agreement, including overdue debt, and the borrower - individual does not exercise the rights provided for in paragraph 1-1 of Article 36 of the Bank Law, or there is no agreement between the borrower - individual and the Bank on changing the conditions of the Agreement, in accordance with paragraph 2-1 of Article 36 of the Bank Law, the Bank has the right to apply measures against the borrower, provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to, transferring the debt for pre-trial collection and settlement to a collection agency (if the Bank has this right under the Agreement), assign the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Bank Law, file a court claim for debt recovery under the Agreement, and target the pledged property in an extrajudicial order, except as provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate", or through court procedures.
