We remind you that in case of the borrower's violation of obligations under the bank loan agreement and failure to satisfy the requirements arising from the Bank's notice of the need to fulfill obligations under the bank loan agreement, the Bank has the right to take the following measures:
In addition to the liability arising from the measures applied by the Bank, the borrower also pays a penalty (fine, delay) in the amount specified in the bank loan agreement for violation of obligations to insure the collateral, including renewal or extension of the insurance contract, obligations on the target use of credit, and violation of other non-monetary obligations according to the terms of the bank loan agreement, and also reimburses to the Bank all losses in full, over and above the penalty, related to the borrower's violation of obligations under the bank loan agreement, and the actions of the Bank related to debt recovery.
We hereby notify that if the borrower is an individual, they have the right within thirty calendar days from the date of delay in fulfilling the obligation under the bank loan agreement (hereinafter - the Agreement) to visit the Bank and/or submit in writing or by a method provided by the Agreement, a statement containing information on the reasons for the late fulfillment of the obligation under the Agreement, income, and other confirmed circumstances (facts) that determine their request to amend the terms of the Agreement, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter - Banking Law). In this case, within fifteen calendar days from the day of receiving the borrower's statement - an individual, as provided in paragraph 1-1 of Article 36 of the Banking Law, the Bank considers the borrower's proposed amendments to the Agreement and informs the borrower - individual in writing or by a method provided by the Agreement about the:
In case of receiving the Bank's decision to refuse to change the terms of the Agreement or if a mutually acceptable solution on amending the Agreement is not reached, the borrower - individual is entitled within 15 (fifteen) calendar days from the date of receiving the Bank's decision to appeal to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, with simultaneous notification of the Bank. If the borrower's requirement to make payments under the Agreement, including overdue debt, is not satisfied, in accordance with paragraph 2 of Article 36 of the Banking Law, the Bank has the right to demand foreclosure in an indisputable manner on funds, including by presenting a payment claim available in the borrower's bank accounts (if such a claim is stipulated in the Agreement), taking into account the restrictions provided by the Banking Law.
In cases of failure by the borrower to satisfy the Bank's requirement to make payments under the Agreement, including overdue debt, and if the borrower - individual does not exercise the rights provided by paragraph 1-1 of Article 36 of the Banking Law, or in the absence of an agreement between the borrower - individual and the Bank on changing the terms of the Agreement, the Bank is entitled under paragraph 2-1 of Article 36 of the Banking Law to apply measures provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including, but not limited to, transferring the debt for pretrial collection and settlement to a collection agency (if such a right of the Bank is provided in the Agreement), assign the right (demand) under the Agreement to the person specified in paragraph 4 of Article 36-1 of the Banking Law, file a lawsuit in court for the recovery of the debt amount under the Agreement, and also initiate foreclosure on pledged property in an out-of-court manner, except in cases provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate", or in a judicial procedure.
