Notice of JSC 'Nurbank' rights and borrower - individual responsibility in case of failure to fulfill obligations under the bank loan agreement

In cases of non-performance and/or improper performance by the borrower of obligations under the Agreement, the Bank is entitled to:

We remind you that in case of the borrower breaching obligations under the bank loan agreement and failing to satisfy demands arising from the Bank's notice of the need to perform obligations under the bank loan agreement, the Bank is entitled to take the following measures:

  • apply penalties (fines, fees) provided for in the bank loan agreement for the borrower's breach of obligations under the bank loan agreement;
  • unilaterally seize the borrower's funds in any currency to repay the overdue debt under the bank loan agreement (including, but not limited to, amounts of principal debt, remuneration, penance (fines, penalties), the Bank's expenses and losses, and other payments stipulated in the bank loan agreement, including through direct debit from the account and/or other bank accounts opened with the Bank, and/or by presenting to the borrower's bank accounts, opened in other banks and/or organizations carrying out certain types of banking operations, and other credit organizations the Bank's payment demands or other documents, stipulated by the legislation of the Republic of Kazakhstan; and/or
  • file a claim in court to recover the borrower's debt under the bank loan agreement, as well as target the pledged property in extrajudicial order or through court procedures; and/or
  • transfer the borrower's debt under the bank loan agreement for pre-trial collection and settlement to a collection agency; and/or
  • assign the Bank's claims under the bank loan agreement in favor of third parties without the borrower's consent, taking into account the requirements of the legislation of the Republic of Kazakhstan; and/or
  • change the terms of performance of the bank loan agreement in ways indicated in the bank loan agreement; and/or
  • require the borrower to fulfill obligations to repay the debt on the loan, both fully and in part determined by the Bank, including demand early fulfillment of all obligations under the bank loan agreement, as well as other transactions concluded between the Bank and the borrower; and/or
  • unilaterally, out of court, refuse to provide the borrower with a loan or suspend the provision of the loan without sending any Bank notifications to the borrower about this: and/or
  • demand the provision of collateral that fully covers the amount of obligations under the bank loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to liability arising from the aforementioned measures applied by the Bank, the borrower also pays a penalty (fine, fee) in the amount specified in the bank loan agreement for the breach of obligations to insure the collateral, including renewal or extension of the insurance contract, obligations for the targeted use of the loan, and breach of other non-monetary obligations in accordance with the terms of the bank loan agreement, as well as reimburses the Bank for all losses in full amount beyond the penalty, associated with the borrower's breach of obligations under the bank loan agreement and the Bank's actions related to debt collection.

We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date the overdue obligation under the bank loan agreement (hereinafter - the Agreement) occurred to visit the Bank and/or submit in written form or by the manner provided for by the Agreement an application containing information about the reasons for the overdue obligation under the Agreement, income, and other confirmed circumstances (facts) that justify their application for amendments to the conditions of the Agreement, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter - Bank Law). In this regard, within fifteen calendar days after the date of receipt of the application from the borrower - individual, provided for in paragraph 1-1 of Article 36 of the Bank Law, the Bank examines the changes proposed by the borrower - individual to the conditions of the Agreement and in written form or by the manner provided for by the Agreement notifies the borrower - individual about (of):

  1. agreement with the proposed changes to the conditions of the Agreement;
  2. its proposals for changing the conditions of the Agreement;
  3. refusal to change the conditions of the Agreement with a justified reason for such refusal.

In case of the Bank's decision to refuse changes to the conditions of the Agreement or failure to reach a mutually acceptable decision on changing the conditions of the Agreement, the borrower - individual, within 15 (fifteen) calendar days from the date of receipt of the Bank's decision, has the right to apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market with simultaneous notification of the Bank. If the borrower does not comply with the Bank's demand to make payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Bank Law, the Bank has the right to unilaterally target the borrower's funds by presenting a payment demand available on the borrower's bank accounts (if such recovery is stipulated in the Agreement), considering the limitations specified in the Bank Law.

In cases where the borrower does not comply with the Bank's demand to make payments under the Agreement, including overdue debt, and the borrower - individual does not exercise the rights provided for in paragraph 1-1 of Article 36 of the Bank Law, or there is no agreement between the borrower - individual and the Bank on changing the conditions of the Agreement, in accordance with paragraph 2-1 of Article 36 of the Bank Law, the Bank has the right to apply measures against the borrower, provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to, transferring the debt for pre-trial collection and settlement to a collection agency (if the Bank has this right under the Agreement), assign the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Bank Law, file a court claim for debt recovery under the Agreement, and target the pledged property in an extrajudicial order, except as provided by the Law of the Republic of Kazakhstan "On Mortgage of Real Estate", or through court procedures.

Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

What are the ways to pay the monthly credit payment?

The payment can be made through the Nur24.kz mobile app, Nurbank terminals, as well as through the cash desks in the Bank's branches.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

No. At present, all loans are processed through the branches of Nurbank.

Can I purchase real estate on the secondary market through Nurbank?

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?
