Notice of JSC 'Nurbank' Rights and Borrower's Liability in Case of Non-fulfillment of Obligations under the Bank Loan Agreement

We remind you that in case the borrower violates the obligations under the bank loan agreement and fails to satisfy the requirements arising from the Bank's notice regarding the necessity to fulfill the obligations under the bank loan agreement, the Bank is entitled to apply the following measures:

  • apply the penalties (fines, late fees) provided in the bank loan agreement for the borrower’s violation of their obligations under the bank loan agreement;
  • unilaterally withdraw funds from the borrower in any currency to repay overdue debt under the bank loan agreement (including, but not limited to, amounts of principal debt, remuneration, penalties (fines, late fees), the Bank's expenses and losses, and other payments provided by the bank loan agreement, including by direct debit from the account and/or other bank accounts opened with the Bank, and/or by submitting payment demands to the borrower’s bank accounts opened in other banks and/or organizations performing certain types of banking operations, and other credit organizations as provided by the legislation of the Republic of Kazakhstan; and/or
  • file a lawsuit for the recovery of the borrower's debt under the bank loan agreement and foreclose on the pledged property out of court or through judicial proceedings; and/or
  • transfer the borrower’s debt under the bank loan agreement to a collection agency for pre-trial recovery and settlement; and/or
  • assign the Bank's claims under the bank loan agreement to third parties without the borrower’s consent in compliance with the legislation of the Republic of Kazakhstan; and/or
  • modify the terms of the bank loan contract in the ways indicated in the bank loan agreement; and/or
  • demand the borrower fulfill the obligations to repay the debt under the loan, either in full or in part, as determined by the Bank, including demanding early execution of all obligations under the bank loan agreement and other transactions concluded between the Bank and the borrower; and/or
  • unilaterally refuse to provide the borrower with credit or suspend the provision of credit without notifying the borrower: and/or
  • demand the provision of collateral that fully covers the obligations under the bank loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to liabilities arising from the aforementioned measures applied by the Bank, the borrower is also subject to a penalty (fine, late fee) in the amount determined by the bank loan agreement for violating obligations related to the insurance of the collateral, including renewal or extension of the insurance agreement, obligations related to the targeted use of the loan, and violation of other non-monetary obligations in accordance with the bank loan agreement terms. The borrower is also liable for compensating the Bank for all losses in full above the penalty amount associated with the borrower's violation of obligations under the bank loan agreement and the Bank’s actions related to debt recovery.

We inform you that if the borrower is an individual, they are entitled to visit the Bank and (or) submit in written form or in a manner provided by the Agreement, within thirty calendar days from the date of overdue performance under the bank loan agreement (hereinafter - the Agreement), a statement containing information on the reasons for the overdue performance under the Agreement, income, and other confirmed circumstances (facts) that justify their request for amendments to the Agreement terms, according to Clause 1-1 of Article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking Activity in the Republic of Kazakhstan' (hereinafter - the Law on Banks). Within fifteen calendar days after the day of receiving the individual borrower's application, as stipulated in Clause 1-1 of Article 36 of the Law on Banks, the Bank reviews the proposed changes to the Agreement terms and informs the individual borrower in written form or as provided by the Agreement about:

  1. the agreement to the proposed changes in the Agreement terms;
  2. the Bank’s proposals for changes in the Agreement terms;
  3. the refusal to change the Agreement terms stating the reasons for such refusal.

In case of receiving the Bank's decision to refuse changes in the Agreement terms or not reaching a mutually acceptable decision on amendments to the Agreement terms, the individual borrower is entitled within 15 (fifteen) calendar days from the date of receiving the Bank's decision, to apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, simultaneously notifying the Bank. In case the borrower fails to meet the Bank's payment requirements under the Agreement, including overdue debt repayment, according to Clause 2 of Article 36 of the Law on Banks, the Bank is entitled to indisputably claim the funds, including by presenting a payment demand on the borrower's bank accounts (if such collection is specified in the Agreement), considering the limitations stipulated by the Law on Banks.

In cases where the borrower fails to meet the Bank's payment requirements under the Agreement, including overdue debts, and also fails to exercise the rights provided in Clause 1-1 of Article 36 of the Law on Banks, or there is no agreement between the individual borrower and the Bank on changes to the Agreement terms, according to Clause 2-1 of Article 36 of the Law on Banks, the Bank is entitled to apply measures towards the borrower as provided by the legislation of the Republic of Kazakhstan and (or) the Agreement, including, but not limited to, transferring the debt for pre-trial collection and settlement to a collection agency (if the Bank has such a right under the Agreement), assign the right (claim) under the Agreement to the person specified in Clause 4 of Article 36-1 of the Law on Banks, file a lawsuit for the recovery of the debt amount under the Agreement, and foreclose on the pledged property out of court, except for cases provided by the Law of the Republic of Kazakhstan 'On Mortgage of Real Estate', or through legal proceedings.

The minimum term is 12 months, the maximum term is 60 months.

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

What documents are needed to obtain a loan?

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?
