Notice of Rights of JSC 'Nurbank' and the Responsibility of the Borrower - Individual in Case of Non-fulfillment of Obligations under the Bank Loan Agreement

We remind you that in case of the borrower's breach of obligations under the loan agreement and failure to satisfy the Bank's demands arising from the notice regarding the necessity to fulfill obligations under the loan agreement, the Bank is entitled to take the following actions:

  • apply penalties (fines, fees) stipulated by the loan agreement for the borrower's violation of their obligations under the loan agreement;
  • debit funds from the borrower's account in any currency to settle overdue debts under the loan agreement (including but not limited to principal debt, remuneration, penalty amounts (fines, fees), the Bank’s expenses and losses, and other payments stipulated by the loan agreement) without dispute, including direct debit from the borrower's account or by presenting payment demands to the borrower’s accounts in other banks and financial organizations;
  • initiate legal proceedings to claim the borrower’s outstanding debts under the loan agreement and seize collateral either judicially or extra-judicially;
  • assign pre-judicial debt collection and settlement to a collection agency;
  • transfer the Bank's claim rights under the loan agreement to third parties without the borrower's consent, observing the laws of the Republic of Kazakhstan;
  • alter the conditions for fulfilling the loan agreement as specified therein;
  • demand that the borrower fulfill debt repayment obligations entirely or in part as defined by the Bank, including requiring early fulfillment of all obligations under the loan agreement and any other contracts between the Bank and the borrower;
  • unilaterally suspend or refuse to extend credit to the borrower without prior notice;
  • require collateral that wholly covers the obligations under the loan agreement;
  • exercise other rights stipulated by the laws of the Republic of Kazakhstan and the loan agreement.

In addition to the liability resulting from the above measures taken by the Bank, a penalty (fine, fee) as determined by the loan agreement shall also be payable by the borrower for failing to fulfill obligations related to insuring the collateral and other non-monetary obligations, as well as compensating the Bank for all losses incurred beyond the penalty due to the borrower’s breaches and the operative measures taken by the Bank for debt recovery.

We inform you that if the borrower is an individual, they have the right, within thirty calendar days from the date of delay in their obligation performance under the loan agreement (hereafter - Agreement), to visit the Bank and/or submit a written application detailing the reasons for the delay, income, and other substantiated circumstances affecting the borrower's request to amend the Agreement terms, in accordance with paragraph 1-1, Article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking in the Republic of Kazakhstan' (hereafter - Banking Law). The Bank will then consider the proposed amendments within fifteen calendar days from receiving the borrower's application, as outlined in paragraph 1-1, Article 36 of the Banking Law, and notify the borrower in writing about:

  1. agreement with the proposed changes to the Agreement;
  2. their own proposals for amending the Agreement;
  3. refusal to change the Agreement terms with justification for the refusal.

If the Bank's decision results in a refusal to amend the Agreement terms, or if no mutual agreement is reached, the individual borrower has fifteen calendar days from the Bank’s decision date to apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, simultaneously notifying the Bank. If the borrower does not satisfy the Bank's payment requirements under the Agreement, including overdue debts, according to paragraph 2 of Article 36 of the Banking Law, the Bank is entitled to enforce undisputed repayment demands, including presenting payment requirements on the borrower's accounts, considering the limitations outlined in the Banking Law.

In cases where the borrower fails to meet the Bank's requirements for payment under the Agreement—particularly overdue debts—or if the individual borrower does not exercise the rights under paragraph 1-1 of Article 36 of the Banking Law, or if there's no consensus between the borrower and the Bank on modifying Agreement conditions, the Bank, in accordance with paragraph 2-1, Article 36 of the Banking Law, reserves the right to enforce measures provided by the Kazakh legislation and/or Agreement, which may include transferring the debt to a collection agency (if specified in the Agreement), assigning the claim rights under the Agreement as described in paragraph 4 of Article 36-1 of the Banking Law, initiating proceedings to claim the debt in court, and enforcing extra-judicial or judicial collateral recovery, except in cases governed by the Law of the Republic of Kazakhstan 'On Mortgages of Immovable Property.'

Who makes the approval decision?

The decision to approve unsecured loans is made by the Bank's automated system or an authorized collegial body. Bank managers and employees do not participate in this process and cannot influence the decision. In each case, the decision is made individually and depends on your credit history and solvency.

What are the ways to pay the monthly credit payment?

The payment can be made through the Nur24.kz mobile app, Nurbank terminals, as well as through the cash desks in the Bank's branches.

For what term can an unsecured loan be issued?

The minimum term is 12 months, the maximum term is 60 months.

What is the maximum loan amount available for external refinancing?

The maximum amount for external refinancing is up to 7,000,000 tenge.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

What documents are needed to obtain a loan?

For unsecured loans:

What is the date of the first loan payment?

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

No. For this, you need to contact the Bank's loan manager

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

We recommend you to repay the overdue debt.

What to do if your phone number/address of registration/residence has changed?

You need to update your personal information. Please visit the nearest Bank branch or notify the Bank in writing.

No. At present, all loans are processed through the branches of Nurbank.

Can I purchase real estate on the secondary market through Nurbank?

Yes, Nurbank offers its own mortgage lending program for purchasing secondary housing.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?

From 21 years of age until reaching retirement age.

Can I purchase a car on credit through Nurbank?
