Notification of Rights of JSC "Nurbank" and the Responsibilities of the Individual Borrower in Case of Non-fulfillment of Obligations Under the Bank Loan Agreement

We remind you that in the event of a borrower's default on the bank loan agreement and not fulfilling the demands derived from the Bank's notice to fulfill obligations under the bank loan agreement, the Bank is entitled to take the following actions:

  • apply penalties (fines, fees) stipulated by the bank loan agreement for the borrower's non-compliance with its obligations under the bank loan agreement;
  • indisputably seize the borrower's funds in any currency to cover overdue debt under the bank loan agreement (including but not limited to the principal debt, remuneration, penalties (fees, fines), the Bank's expenses and losses, and other payments provided for in the bank loan agreement, including by direct debiting from accounts and/or other bank accounts, opened with the Bank, or by presenting payment demands or other documents provided by the legislation of the Republic of Kazakhstan to the borrower's bank accounts, opened with other banks and/or organizations conducting certain banking operations, and other lending institutions; and/or
  • file a lawsuit to collect the borrower's debt under the bank loan agreement and foreclose on the collateral property both extrajudicially and judicially; and/or
  • transfer the borrower's debt under the bank loan agreement for pre-trial collection and settlement by a collection agency; and/or
  • assign the Bank's claims under the bank loan agreement in favor of third parties without the borrower's consent, considering the requirements of the legislation of the Republic of Kazakhstan; and/or
  • change the conditions of executing the bank loan agreement by the methods specified in the bank loan agreement; and/or
  • demand the borrower to fulfill obligations for repayment of debt under the credit fully or partially, as determined by the Bank, including demand early fulfillment of all obligations under the bank loan agreement and other contracts concluded between the Bank and the borrower; and/or
  • unilaterally refuse to provide the borrower with a loan or suspend loan provision without notifying the borrower through any Bank notifications about this: and/or
  • require a pledge of property that fully covers the amount of obligations under the bank loan agreement; and/or
  • exercise other rights prescribed by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to the responsibility arising from the above measures taken by the Bank, the borrower is also required to pay a penalty (fine, fee) in the amount specified in the bank loan agreement for breaching obligations to insure the collateral, including renewal or extension of the insurance contract, obligations on the intended use of the credit, and breach of other non-monetary obligations in accordance with the bank loan agreement, as well as compensate the Bank for all losses in full, beyond the penalty, related to the borrower's breach of obligations under the bank loan agreement and the Bank's activities related to debt collection.

We inform you that if the borrower is an individual, he has the right, within thirty calendar days from the date of delay in fulfilling the obligation under the bank loan agreement (hereinafter - the Agreement), to visit the Bank and/or submit in writing or in the manner provided by the Agreement, a statement containing information about the reasons for the delay in fulfilling the obligation under the Agreement, income, and other confirmed circumstances (facts), which condition his application for changes to the Agreement, according to paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activities in the Republic of Kazakhstan" (hereinafter - the Law on Banks). At the same time, within fifteen calendar days after the day of receipt of the borrower's application - individual, provided by paragraph 1-1 of Article 36 of the Law on Banks, the Bank considers the changes proposed by the borrower - individual, to the Agreement and informs the borrower - individual in writing or in the manner provided by the Agreement, about:

  1. the agreement with the proposed changes to the Agreement;
  2. its proposals for changing the Agreement terms;
  3. refusal to change the Agreement terms with indicating a motivated justification for such refusal.

In case of receiving the Bank's decision to refuse to change the Agreement terms or failing to reach a mutually acceptable decision on changing the Agreement terms, the borrower - individual within 15 (fifteen) calendar days from the date of receiving the Bank's decision, may apply to the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, simultaneously notifying the Bank. If the borrower fails to meet the Bank's demand for necessary payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Law on Banks, the Bank is entitled to collect in a non-disputable manner on the borrower's funds, including by presenting a payment demand, from existing bank accounts of the borrower (if such collection was agreed upon in the Agreement), considering the restrictions provided by the Law on Banks.

In cases where the borrower fails to meet the Bank's demand for necessary payments under the Agreement, including overdue debt, and fails to exercise the rights provided by paragraph 1-1 of Article 36 of the Law on Banks, or where there is no agreement between the individual borrower and the Bank on changing the Agreement terms, according to paragraph 2-1 of Article 36 of the Law on Banks, the Bank is entitled to apply measures prescribed by the legislation of the Republic of Kazakhstan and/or the Agreement to the borrower, including but not limited to transfer the debt for pre-trial collection and settlement to a collection agency (if the Bank has such right in the Agreement), assign the right (claim) under the Agreement to the person specified in paragraph 4 of Article 36-1 of the Law on Banks, file a lawsuit for the recovery of the debt amount under the Agreement, and foreclose on the collateral property extrajudicially, except in cases provided by the Law of the Republic of Kazakhstan "On Mortgage of Immovable Property", or judicially.

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

Can I repay the loan early in the mobile application?

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.
