In addition to the liability arising from the above measures applied by the Bank, the borrower is also liable to pay a penalty (fine, late fee) as determined by the bank loan agreement for the breach of obligations concerning the insurance of the pledged property, including the renewal or extension of the insurance contract, obligations regarding the targeted use of the loan, and violation of other non-cash obligations in accordance with the terms of the bank loan agreement, and to reimburse the Bank for all losses in full sum beyond the penalty, related to the borrower's breach of obligations under the bank loan agreement and the Bank's actions regarding debt collection.
We inform you that if the borrower is an individual, they have the right within thirty calendar days from the date of default of an obligation under the bank loan agreement (hereinafter - Agreement) to visit the Bank and/or submit in writing or in a manner provided by the Agreement a statement containing information about the reasons for the default of an obligation under the Agreement, income, and other confirmed circumstances (facts) justifying their request for changes in the Agreement's terms, in accordance with paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan "On Banks and Banking Activity in the Republic of Kazakhstan" (hereinafter - Banking Law). The Bank shall consider the changes proposed by the individual borrower to the Agreement's terms and notify the individual borrower in writing or as provided for in the Agreement of:
In case of receiving the Bank's decision to refuse to change the Agreement's terms or the absence of a mutually acceptable solution to change the Agreement's terms, the individual borrower may apply within 15 (fifteen) calendar days from the date of receiving the Bank's decision to the Agency of the Republic of Kazakhstan for Regulation and Development of Financial Market, while simultaneously notifying the Bank. If the borrower does not satisfy the Bank's demand to make payments under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Banking Law, the Bank is entitled to initiate undisputed collection against the borrower's funds, including through presenting a payment demand to the borrower's bank accounts (if such collection is stipulated in the Agreement), considering the restrictions provided by the Banking Law.
In cases of non-compliance by the borrower with the Bank's demand to make payments under the Agreement, including overdue debt, or failure of the individual borrower to exercise the rights provided by paragraph 1-1 of Article 36 of the Banking Law, or lack of agreement between the individual borrower and the Bank regarding changing the Agreement's terms, in accordance with paragraph 2-1 of Article 36 of the Banking Law, the Bank is entitled to apply measures provided by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to transferring the debt to a collection agency for pre-trial debt collection and settlement (if the Bank has such a right under the Agreement), assign the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Banking Law, file a lawsuit to recover the debt amount under the Agreement, as well as initiate foreclosure on pledged property without a legal proceeding, except for cases provided by the Law of the Republic of Kazakhstan "On Real Estate Mortgages", or through a court proceeding.
