Notice of Rights of JSC 'Nurbank' and Responsibilities of the Individual Borrower in Case of Non-Compliance with Obligations Under the Bank Loan Agreement

We remind you that in case of borrower’s breach of obligations under the bank loan agreement and borrower’s failure to satisfy the demands arising from the Bank's notice of the need to fulfill obligations under the bank loan agreement, the Bank is entitled to apply the following measures:

  • apply penalties (fines, fees) stipulated by the bank loan agreement for the borrower’s breach of obligations under the bank loan agreement;
  • unilaterally withdraw borrower’s funds in any currency to repay overdue debt under the bank loan agreement (including, but not limited to, debt amounts, remuneration, penalty amounts (fees, fines), Bank’s expenses and losses, and other payments specified by the bank loan agreement, including through direct debiting of the account and/or other bank accounts opened at the Bank, and/or by submitting the Bank’s payment demands or other documents provided by the legislation of the Republic of Kazakhstan to the borrower’s bank accounts opened in other banks and/or organizations performing certain types of banking operations, and other credit institutions; and/or
  • file a lawsuit in court to collect the borrower's debt under the bank loan agreement, as well as foreclose on pledged property out-of-court or by judicial procedures; and/or
  • transfer the borrower’s debt under the bank loan agreement for pre-trial collection and settlement to a collection agency; and/or
  • assign Bank’s claims under the bank loan agreement to third parties without the borrower’s consent, considering the requirements of the legislation of the Republic of Kazakhstan; and/or
  • amend the terms of performance of the bank loan agreement in the manner specified in the bank loan agreement; and/or
  • demand that the borrower fulfill obligations to repay debt on the loan, either in full or in a part determined by the Bank, including demanding early fulfillment of all obligations under the bank loan agreement and other transactions concluded between the Bank and the borrower; and/or
  • unilaterally and extrajudicially deny or suspend lending to the borrower without sending any Bank notices to the borrower; and/or
  • demand collateral covering the full amount of obligations under the bank loan agreement; and/or
  • exercise other rights provided by the legislation of the Republic of Kazakhstan and the bank loan agreement.

In addition to the liability arising from the above measures applied by the Bank, the borrower also pays a penalty (fine, fee) in the amount determined by the bank loan agreement for violating the obligations related to insurance of the pledged asset, including renewal or extension of the insurance contract, obligations regarding the targeted use of the credit, and the violation of other non-monetary obligations in compliance with the conditions of the bank loan agreement. Moreover, the borrower reimburses the Bank for all losses exceeding the penalty associated with the borrower’s breach of obligations under the bank loan agreement and measures undertaken by the Bank in relation to debt recovery.

We inform you that if the borrower is an individual, they are entitled within thirty calendar days from the date of default on the obligation under the bank loan agreement (hereinafter referred to as the Agreement) to visit the Bank and/or submit a written application or in a manner provided by the Agreement, containing information regarding the reasons for the delay in fulfilling the obligation under the Agreement, income, and other confirmed circumstances (facts) that justify their request for amendments to the Agreement, according to paragraph 1-1 of Article 36 of the Law of the Republic of Kazakhstan 'On Banks and Banking Activities in the Republic of Kazakhstan' (hereinafter referred to as the Banking Law). Within fifteen calendar days after receiving the application from the individual borrower, as specified in paragraph 1-1 of Article 36 of the Banking Law, the Bank considers the changes proposed by the individual borrower to the Agreement terms and notifies the individual borrower in writing or in the manner provided by the Agreement about the following:

  1. agreement to the proposed changes to the Agreement terms;
  2. own proposals for amending the Agreement terms;
  3. refusal to change the terms of the Agreement, stating the motivated reasoning for such refusal.

In case the Bank’s decision to refuse amendments to the Agreement terms is received or a mutually acceptable decision regarding amendments is not reached, the individual borrower, within 15 (fifteen) calendar days from the date of the Bank’s decision, is entitled to contact the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market while simultaneously notifying the Bank. If the borrower fails to satisfy the Bank's demand for payment under the Agreement, including overdue debt, in accordance with paragraph 2 of Article 36 of the Banking Law, the Bank is entitled to impose an indisputable collection on funds, including by submitting a payment demand, present in the borrower’s bank accounts (if such collection is stipulated in the Agreement), considering the limitations provided by the Banking Law.

In cases of borrower’s non-compliance with the Bank's demand for payments under the Agreement, including overdue debt, as well as the individual borrower failing to exercise rights stipulated in paragraph 1-1 of Article 36 of the Banking Law, or absence of agreement between the individual borrower and the Bank concerning the amendment of the Agreement terms, according to paragraph 2-1 of Article 36 of the Banking Law, the Bank is entitled to apply measures against the borrower prescribed by the legislation of the Republic of Kazakhstan and/or the Agreement, including but not limited to transferring the debt for pre-trial collection and settlement to a collection agency (if such a right is stipulated in the Agreement), assign the right (claim) under the Agreement to a person specified in paragraph 4 of Article 36-1 of the Banking Law, file a lawsuit to recover the debt amount under the Agreement, as well as foreclose on pledged assets out of court, except for cases provided by the Law of the Republic of Kazakhstan 'On Mortgage of Real Estate', or through judicial procedures.

For what term can an unsecured loan be issued?

Can a non-resident of Kazakhstan obtain a loan?

Loans are considered and granted only to residents of Kazakhstan. The bank considers the possibility of granting loans to non-residents of Kazakhstan if they have a residence permit.

What is the minimum monthly income required to qualify for a loan?

The confirmed income must be at least 150,000 (one hundred fifty) thousand tenge. In each specific case, the decision is made individually and depends on the quality of the credit history and your creditworthiness.

Can I deposit money to repay the loan several months in advance?

Yes. In this case, repayment will occur according to the payment schedule.

Is there a commission (penalty) for early (full/partial) loan repayment?

No, there is no commission for early loan repayment. However, the minimum amount for partial early repayment must be at least 3 (three) monthly payments. The number of partial early repayments is not limited.

How to execute a full early repayment?

To do this, you need to contact the Bank's credit manager to clarify the terms and amount of early repayment.

The payment was made through the terminal, but there was a technical failure and the money did not reach the account. What should be done?

You need to contact the nearest Bank branch or call the Contact Center at 2552. After confirming the technical failure and crediting the funds to the credit account, the payment will be settled according to the schedule, any penalty (if applicable) will be annulled, and a positive credit history will be maintained.

Within what time does the Bank inform the borrower of a delay?

The Bank notifies of a delay in fulfilling obligations and the need to make payments no later than 20 calendar days from the date it occurs, in the manner stipulated in the Bank loan agreement.

What happens if I forget to make a payment according to the DCL schedule?

Missing a payment can negatively impact your credit history. Remember to repay your loan on time. In case of a missed payment, the Bank imposes fines/penalties in accordance with the terms of the bank loan agreement.

What should I do if I have a delay?

What to do if your phone number/address of registration/residence has changed?

No. At present, all loans are processed through the branches of Nurbank.

Who conducts the appraisal of collateral?

The initial appraisal of collateral is performed by independent appraisal organizations. The secondary appraisal is conducted by the Bank's branch appraisal service by visiting the location of the collateral to determine the adequacy of the independent appraiser's valuation.

Can I refinance a mortgage taken out from another bank?

Yes, the Bank offers refinancing for loans from other banks, provided there are no overdue debts. To refinance, please visit the nearest branch.

At what age can I apply for an unsecured loan/minimum and maximum age to apply for a loan?
